The Case of the Speluncean Explorers

For the this class, please do two things:

• Look over the syllabus included with the photocopied materials and consider:
• Are there topics on which you would like us to focus?
• Do any of the readings sound particularly interesting?
• Is there something missing you would like to see included?
• [Don't panic--last year we didn't get through all of it.]
• Read the first item: The Case of the Speluncean Explorers.
• Please be ready to explain how you would decide the case, and why.
• Be ready to summarize the premises on which the various opinions are based. In particular, how does each judge answer the following questions:
• What law applies?
• What weres and are the sources of obligation applicable to the defendants?
• What were and are the sources of obligation applicable to the judges?
• Are those all the same question in different form, or are there meaningful differences?
