The Case of the Speluncean Explorers
For the this class, please do two things:
- Look over the syllabus included with the photocopied materials and
consider:
- Are there topics on which you would like us to focus?
- Do any of the readings sound particularly interesting?
- Is there something missing you would like to see included?
- [Don't panic--last year we didn't get through all of it.]
- Read the first item: The Case of the Speluncean Explorers.
- Please be ready to explain how you would decide the case, and why.
- Be ready to summarize the premises on which the various opinions are
based. In particular, how does each judge answer the following questions:
- What law applies?
- What weres and are the sources of obligation applicable to the defendants?
- What were and are the sources of obligation applicable to the judges?
- Are those all the same question in different form, or are there meaningful
differences?
